LEGAL & DISCLAIMERS

Read this before you use anything here.

Ninth Candle publishes research produced by an automated trading system (“Wick”). Everything on this site, in our Telegram channels, and in our dashboards is provided for educational and informational purposes only. If you take nothing else from this page: this is not investment advice, the system makes mistakes, and futures trading can lose you money quickly.

The binding agreement itself — the Terms of Service every account accepts at signup — is published in full at /terms, with a downloadable PDF.

1. Not investment advice

Nothing published by Ninth Candle is investment, financial, legal, or tax advice, and nothing is a recommendation to buy or sell any security, futures contract, or other instrument. All content is impersonal market research: it is not tailored to your financial situation, objectives, or risk tolerance, and it does not create any advisory or fiduciary relationship. Ninth Candle is not a registered investment adviser, commodity trading advisor, broker-dealer, or futures commission merchant. Before trading, consult a licensed financial professional who knows your circumstances.

2. The system makes mistakes

Wick is an automated system built on historical statistical testing. No system — and no person — is right 100% of the time, and this one is not designed to be: it is engineered to take frequent small losses in pursuit of occasional larger wins, which means losing trades, losing weeks, and losing streaks are a normal, expected part of its operation, not a malfunction. Beyond ordinary losses, automated systems can fail in other ways: data feeds stall, servers go down, messages arrive late or not at all, and software contains bugs. Signals may be delayed, wrong, or missing entirely. Never place a trade you cannot afford to have go against you on the assumption that a message was complete, timely, or correct.

3. Substantial risk of loss

Trading futures involves substantial risk of loss and is not suitable for all investors. Futures are leveraged instruments: small market moves produce large gains and large losses, and you can lose more than your initial investment. Only risk capital — money you can afford to lose entirely without changing your life — should ever be used for trading. You alone are responsible for every trading decision you make, including position sizing, order placement, and risk management in your own account at your own broker.

4. Hypothetical and simulated performance

Performance figures published by Ninth Candle — including Wick’s historical record — are based in whole or in part on simulated (paper) trading and historical backtesting unless explicitly stated otherwise. HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, BECAUSE THE TRADES HAVE NOT ACTUALLY BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.

5. Past performance

Past performance, whether actual or simulated, is not indicative of future results. Market conditions change, and an edge that existed historically can weaken or disappear without warning.

6. Signals are sizing-neutral

Published signals express risk in “R” — one unit of whatever you choose to risk per trade. Ninth Candle does not know your account size and never tells you how much money to risk. Choosing an appropriate risk amount for your own account is your responsibility; risking more than a small percentage of your account on any single trade can lead to rapid, unrecoverable losses.

7. Delivery and third-party platforms

Signals are delivered through third-party services (including Telegram) and depend on market-data vendors, hosting providers, and networks that Ninth Candle does not control. Ninth Candle does not guarantee that any message will be delivered, delivered on time, or delivered without error, and is not liable for losses arising from delays, outages, or failures of any kind.

8. Subscriptions

A Ninth Candle subscription purchases access to educational research content for the subscription period. It does not purchase trading results, profits, or performance of any kind, and no refund is owed because markets or the system performed poorly. Subscription terms, billing, cancellation, and refund policies are stated at checkout and may be updated from time to time.

9. Limitation of liability

To the maximum extent permitted by law, Ninth Candle and its owners, operators, and contributors shall not be liable for any direct, indirect, incidental, consequential, or special damages — including lost profits and trading losses — arising from the use of, or inability to use, any content, signal, software, or service we provide, even if advised of the possibility of such damages. Your sole remedy for dissatisfaction with the service is to stop using it.
